Trump breaks down his ‘punishable by death’ threat to ‘seditious’ Democrats for Fox News host

On Friday, former President Donald Trump appeared to soften his stance on a controversial statement he made a day earlier, where he suggested that six Democratic lawmakers should face execution for what he described as "seditious behavior." During an interview on a right-wing radio program hosted by Brian Kilmeade, Trump clarified that his original comments were referring to practices "in the old days," implying that such punishments were historical rather than a contemporary call to action. The lawmakers targeted by Trump included Sens. Elissa Slotkin of Michigan and Mark Kelly of Arizona, along with Representatives Jason Crow from Colorado, Maggie Houlahan from New Hampshire, and Chris Deluzio and Chrissy Houlahan from Pennsylvania. Trump accused these members of Congress—all of whom have backgrounds in the military or intelligence—of committing "seditious behavior at the highest level." He labeled them "traitors to our country" and demanded they be "arrested and put on trial" after they appeared in a video urging U.S. service members to "refuse illegal orders" while upholding their oaths to the Constitution. In a follow-up post, Trump repeated his charge of "SEDITIOUS BEHAVIOR" in capital letters and claimed that such conduct was "punishable by DEATH." This aggressive rhetoric drew strong condemnation, not only from Democrats but also from some Republicans and national security experts, who saw it as another instance of Trump leveraging official power against political opponents. Critics expressed concerns about the dangerous precedent of a former president calling for capital punishment against lawmakers based on their political speech. However, during the Fox News interview, Trump walked back his threat, stating, "In the old days, if you said a thing like that, that was punishable by death." He insisted he was not directly threatening the legislators but suggested they were "in serious trouble." Notably, Trump also shared a repost from a Truth Social user advocating the hanging of these Democrats, which complicated the public perception of his distancing. From a legal perspective, there appears to be little basis to prosecute the lawmakers for urging service members to disobey illegal orders. Members of Congress enjoy broad immunity for official acts, and political speech is strongly protected by the First Amendment. Moreover, the United States repealed its World War I-era Sedition Act in 1920, and current federal law criminalizing "seditious conspiracy" only applies to conspiracies involving forceful actions against the government, such as attempts to "levy war against the government" or to "prevent, hinder, or delay" law enforcement by force. Conviction under that statute carries a maximum penalty of 20 years imprisonment, not death. Trump’s claims that seditious behavior merits the death penalty do not align with existing U.S. criminal law. The last known use of the seditious conspiracy charge was against participants in the January 6 Capitol riot, and even then, it did not carry capital punishment. The episode highlights ongoing tensions around political discourse, legal boundaries, and the use of incendiary language by prominent political figures.
