Criminal case dismissed against Boeing in the deadly MAX crashes

A federal judge has dismissed the criminal case against Boeing related to two tragic crashes involving its 737 MAX aircraft. The crashes, which claimed the lives of 346 people, involved Lion Air Flight 610, which crashed off the coast of Indonesia on October 29, 2018, and Ethiopian Airlines Flight 302, which went down shortly after takeoff from Addis Ababa on March 10, 2019. The Justice Department moved to have the criminal case dropped, and U.S. District Judge Reed O'Connor agreed to the request despite expressing serious doubts about the decision. He noted the dismissal ‘‘fails to secure the necessary accountability to ensure the safety of the flying public.’’ Family members of the victims voiced strong disappointment and criticized the Justice Department’s decision as a betrayal of justice. Mark Lindquist, who represents several families in civil suits against Boeing, pointed out that many relatives feel the company has not been held fully accountable. He also highlighted ongoing concerns that without criminal accountability, Boeing might not implement the vital changes needed to improve quality control and prevent future tragedies. As part of a plea agreement reached in May, Boeing agreed to pay $1.1 billion in fines and compensation to the families affected by the crashes. The company also pledged to enhance its quality and safety systems moving forward. Unlike a previous deal rejected by Judge O’Connor, Boeing will not be supervised by an independent monitor. Instead, responsibility for oversight now rests with the Federal Aviation Administration (FAA), the very agency criticized for failing to identify and prevent the safety issues that led to the crashes. The earlier arrangement required Boeing to plead guilty to a fraud charge related to deceiving the FAA about flaws in the flight navigation system implicated in both accidents. However, with the dismissal, Boeing will not enter any criminal guilty plea and likely never will. Lindquist described the end of the criminal proceedings as ‘‘a long, arduous process’’ that has now concluded. Boeing issued a statement reiterating its commitment to honoring the Justice Department agreement and continuing efforts to bolster safety, quality, and compliance within the company. The dismissal marks a significant turning point in the legal aftermath of the 737 MAX disasters, though it leaves many questions unanswered for victims’ families and aviation safety advocates. The reliance on FAA oversight raises concerns given the agency’s criticized role in the pre-crash certification processes.
